I. Introduction
These Terms & Conditions govern your access and use of the LVLFi websites, including website related applications (“websites”) of LVLFi Ltd its affiliates and subsidiaries (as used here ” LVLFi” refers to LVLFi Ltd, its affiliates and subsidiaries, jointly and severally). All information accessed or viewed is considered confidential and is only for authorized personal purposes.
The LVLFi application and websites are solely intended for use by individuals who are 18 years of age or older. If you are under the age of 18, please do not download or use the LVLFi application and websites.
II. Acceptance of Terms
These websites are the property of one or more of the member companies and/or affiliates of LVLFi. By linking, referencing, using or accessing websites of LVLFi, you agree to these Terms and Conditions, including agreeing to indemnify and hold harmless LVLFi from all claims of any nature arising from your access and use of these websites.
These Terms and Conditions may be changed at any time at the sole discretion of LVLFi. These Terms and Conditions pertain to the LVLFi websites of LVLFi.
III. Incentives and Rewards
LVLFi allows you to earn points for activities completed by you or based on information you share with LVLFi via specified third party applications or platforms. LVLFi is not responsible for technical difficulties, errors or delays related to the use of your third-party applications with the LVLFi program.
If you qualify to participate, points can be redeemed for select gift cards or other prizes at the sole discretion of LVLFi. An individual is eligible for a maximum of $500 in gift cards over a three (3) month period, unless otherwise stated. You must be a member of a qualifying LVLFi client to be eligible to receive gift cards under the incentive and rewards program. As part of the download process, you will be informed within the application whether you are eligible to receive gift cards.
Program points must be redeemed by the user during the applicable program period. Any program points available through LVLFi that have not been redeemed prior to program cancellation or completion through the websites will be forfeited. Program points are non-transferrable.
IV. Secure Websites
By using, accessing or attempting to access websites of LVLFi that require you to log in (these are defined as “secure websites”), you are certifying you are the person legally associated with the username, password, or additional method(s) of authentication being used. Unauthorized access or use or attempts to access or use secure websites of LVLFi is prohibited and may violate federal and/or state law. LVLFi may report unauthorized access, use or attempts to access or use to law enforcement.
Customer access to web and mobile applications of LVLFi requires the use of unique user names and strong passwords. LVLFi uses adaptive authentication systems to help verify the identity of the user which include multi-factor authentication, security questions and answers, and timed log-off.
LVLFi has a comprehensive written Information Security Program that safeguards information against unauthorized or accidental modification, disclosure, fraud, and destruction. In addition to steps we take to secure your account information, your actions play a big part in protecting your data, too.
Choose a secure password.
Do not use the same password on other websites. If other sites are not secure, your password could be compromised.
Choose a password that is not a duplicate of other personal information (e.g., do not use your Social Security number, date of birth, etc.)
Use at least 8 characters, and vary the types of characters in your passwords, if possible. Using combinations of capital letters, numbers, and special characters makes passwords more difficult to figure out. If possible, use more than 8 characters to increase password complexity.
Do not disclose your login information to anyone. Our employees and associates will never ask for your password.
If you need to write your login information down, keep it in a safe place where others can’t see it.
Contact us immediately to change your login if you suspect someone has discovered it.
Secure your personal device with a password or passcode of at least 6 characters.
V. Intellectual Property; Link and Logo Licensing
The content found on websites of LVLFi, including without limitation, the text, graphics, videos, selection and arrangement of information, and page layouts, is protected by copyright and other intellectual property laws and treaties. You may download and print copyrighted materials for your personal non-commercial use only. You may not modify, transmit, or distribute any of the copyrighted materials without the specific written consent of LVLFi.
Trademarks, service marks and logos used on websites of LVLFi are registered and unregistered trademarks, protected by the laws of the United States and other countries worldwide. Trademarks, service marks and logos used on these websites that have been provided by others are the property of their respective owners. You may not use any of the trademarks, service marks or logos found on these websites without the specific written consent of LVLFi or their respective owners.
VI.Privacy
All personal information is subject to LVLFi’s privacy policies. The information you provide to LVLFi is kept secure and confidential through multiple security features and procedures. Review the LVLFi Privacy Policy for further information.
VII. Participant Health
Your participation in any physical activity challenges is strictly voluntary and at your own risk. You should consult with your healthcare provider before beginning any activity challenge to determine whether participation in the program is appropriate for you.
The LVLFi program does not provide medical advice.
VIII. Tax Inplication
Rewards earned through your participation in the LVLFi program may be considered taxable to you. You should consult with your tax advisor for specific tax advice regarding the program.
IX. Links to Others Sites – Limitation of Liability
LVLFi may provide, or third parties may provide, for your convenience and information only, links to other websites. Because LVLFi does not have control over these sites, you agree that LVLFi is not responsible for any liability resulting from the access or use of sites not owned by LVLFi and that LVLFi is not responsible for any content, advertising, product, or any other matter or issue, available online, whether linked to, or from, websites of LVLFi. Further, you agree that LVLFi shall not be responsible or liable, directly or indirectly, for any damage or loss caused, or alleged to be caused by or in connection with the use of websites LVLFi does not own.
X. Third-Party Applications – Modification Prohibited
LVLFi may provide you with access to third-party applications and services through its websites. You agree not to modify, decompile or reverse engineer any such third-party applications, or any code related to such third-party applications.
XI. Termination and Blocking
You agree that LVLFi reserves the right to terminate and/or block your use or access of its websites for any reason without prior notice to you.
XII. Monitoring
LVLFi reserves the right to monitor your access and use of its websites without notification to you. LVLFi may record or log your use in a manner as set out in our privacy policies.
XIII. Hardware and Software Recommendations
You can access our websites using a current internet browser. If you’re on an older browser and are having issues with our site, we suggest you install a more current browser.
XIV. Export Control
The United States controls the export of products and information. You agree to comply with such restrictions and not to export or re-export any material to countries or persons prohibited under the export control laws. By downloading any material, you are agreeing that you are not in a country where such export is prohibited and that you are not a person or entity to which such export is prohibited. You are responsible for compliance with the laws of your local jurisdiction regarding the import, export, or re-export of any material.
XV. Limitation of Liability
You agree that your access to, and use of, the websites of LVLFi and the content thereof is at your risk.
You agree that under no circumstances shall LVLFi be liable for any direct, indirect, incidental, special, consequential, punitive or exemplary damages arising from viruses, worms, trojan horses or other code that has contaminating or destructive properties or our reference, using, accessing, inability to use or access or linking to or from the websites of LVLFi or any errors or omissions in the content thereof. There are some jurisdictions that do not allow for the exclusion of certain warranties or the limitation or exclusion of liability for consequential or incidental damages. Based on this conclusion, the liability of LVLFi is limited to the greatest extent permitted by law.
IN NO EVENT WILL LVLFI, OUR AFFILIATES, OR ANY OF OUR SERVICE PROVIDERS BE LIABLE FOR ANY DAMAGES ARISING OUT OF YOUR PARTICIPATION IN PHYSICAL ACTIVITY CHALLENGES OR OTHER CHALLENGE ACTIVITIES RELATED TO THE LVLFI PROGRAM, INCLUDING BUT NOT LIMITED TO ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBLITY OF SUCH DAMAGES.
XVI. Governing Law; Severability
These Terms & Conditions are governed by the laws of the State of Delaware with jurisdiction and venue being in the State of Delaware. You agree that your referencing, using, or accessing websites of LVLFi constitutes your acceptance of the jurisdiction of state or federal courts in the State of Delaware and that legal action may be brought against, or by, you must be brought in state or federal courts in the State of Delaware.
In the event any of the provisions of these Terms & Conditions shall be determined by a court of competent jurisdiction to be invalid, any such provision determined to be invalid shall not affect the validity of all remaining provisions.
XVII. Social Media & Blog Commenting
We welcome comments, opinions and questions. Anything threatening, libelous, defamatory, obscene, pornographic or other material that would violate the law will be deleted.
We take our customers’ security very seriously. We do not respond to any questions that pertain to a specific individual, account, or financial issue.
We do not endorse any of the third-party content posted on our social media properties, nor do we have any control over it. No part of our social media properties is intended to act as a recommendation, suggestion, or testimonial for any service or product.
